GENERAL
These terms and conditions apply to all goods purchased from Solar Plexus, whether purchased in person, by mail order, via our website or online shop except where other terms and conditions have been agreed to.
All goods are sold 'ex- works'. This means that the costs of transporting the goods to and from our premises is the sole responsibility of the customer. If necessary we can organise transportation on behalf of the customer (by prior arrangement). This will form a separate contractual arrangement.
Solar Plexus reserves the right to refuse any order at our discretion without obligation to provide you with any reasons for refusing an order.
Solar Plexus offers trade accounts to installers and other tradesmen at our discretion, and also reserves the right to remove this privelege at any time.
GUARANTEE
All goods are guaranteed for 12 months against defects in workmanship with the exception of Photovoltaic solar panels and inverters which are warranted for 10 years and 5 years respectively, unless otherwise specified. The guarantee covers replacement of faulty parts. This does not affect statutory rights. If a refund is offered, the goods must be returned to Solar Plexus, before the refund can be issued. In the event of a component failure due to faulty components or workmanship, the component will be replaced free of charge during the guarantee period only. Once we have established the reason for failure, Solar Plexus may refund the shipping costs assuming that the item(s) has failed due to faulty workmanship or materials. If the item has failed due to wear and tear, misuse or damage, no refund will be issued. Alternatively, the customer may visit our premises by arrangement to exchange the faulty unit. No exchange will be given without the return of the original part, although obviously this does not affect your statutory rigths. This guarantee has specific exclusions:
Wear and tear
Accidental damage or damage due to misuse
Damage caused to wind turbines and electronics by exposure to high winds, or gusts exceeding the maximum design speed of the turbine. The turbines we supply are designed for high output at low wind speed, and are therefore unsuitable for high wind areas. Use of these wind turbines in coastal areas or use in other high-wind areas is at the customer's risk only.
Damage caused to electrical components by disconnecting any component during operation. Disconnection of the inverter, batteries, charge controller or turbine whilst any component is powered/delivering power can cause irreversible damage. This type of misuse is not covered by the guarantee.
The guarantee is automatically invalidated if any part of a system is modified (even if the modified part is not the component that has failed), unless prior agreement is obtained in writing from Solar Plexus
Damage caused to the wind turbine or blades caused by over-spinning due to running without suitable load or battery connected
Damage caused to wind turbine by out-of-balance hub/blades. The responsibility of balancing the blades lies with the installer, who must do so AFTER assembly
Damage caused to wind turbine blades due to abrasion by particles carried by the wind.
No liability is accepted for any damage caused to persons or property as a result of failure to follow product safety instructions, misuse, or as a result of alternative installation methods, fixings or applications outside of those set out by Solar Plexus All machinery and equipment supplied by Solar Plexus, and wind turbines in particular should be operated a safe distance from individuals and property. If you are unsure of the acceptable safe distance, please consult before setting up the equipment. The turbine should not be erected where tower failure or turbine failure can cause the machinery to fall onto cars, individuals or propety. When the wind turbine is operational, no personnel should come within a distance equivalent to twice the tower height for safety reasons. Any injury caused by failing to heed these warnings will not be the liability of Solar Plexus Solar Plexus denies any liability for damage to any other equipment that may be used in conjunction with our products unless it can be demonstrated that our equipment is at fault. This is because we have no control over what equipment is used or how it may be used, and therefore we are not in a position to guarantee its safeguard. Sometimes incompatibility can occur between different types of equipment, or some equipment may be designed for light duty use only - although this may not be immediately apparent. If in doubt please consult us beforehand. Damage to batteries due to excessive deep discharge, short-circuiting, excessively high load, excessive charging, loss of electrolyte, failure to maintain electrolyte level, topping up using fluid other than distilled or deionised water or any weather condition outside of the manufacturer's specification for battery use.
FINANCIAL
1. Title to all goods and equipment remains with Solar Plexus until paid in full. Solar Plexus reserves the right to collect, dismantle and/or remove equipment and to arrange its return in the event of non-payment. Solar Plexus will not be responsible for any losses incurred by the customer by Solar Plexus exercising this right. In the event of non-payment or returned payment, any costs incurred by Solar Plexus in recovering its property will be the responsibility of the customer. Solar Plexus reserves the right to take all necessary steps to recover equipment that has not been paid for. The customer grants Solar Plexus access to repossess any equipment not paid for in full.
2. Goods may be returned within 7 days (including weekends) for a refund, only if they are returned unused and in original packaging. This does not affect your statutory rights.
3. No refund will be given for goods that have been modified or damaged. Because of the nature of the goods, it is essential that they are returned in the original packaging in order to provide adequate protection in shipping. If the original packaging is not available the customer should contact Solar Plexus to discuss adequate return packaging before the sending the goods. No refund will be given for items that have been dismantled, tampered with or have parts missing, unless by prior agreement in writing.
4. Solar Plexus does not operate any credit facilities or monthly accounts. All payments are due on or before the date of despatch. Any overdue amount, if arranged prior to shipment of goods, will be charged at an interest rate of 2% per month. Interest charges will be round UP to the nearest month.
5. The customer will be responsible for any costs incurred to Solar Plexus in failed payments from customers - for example cheques returned either unpaid or stopped. Any costs incurred by Solar Plexus in recovering these debts will be the responsibility of the customer. Solar Plexus reserves the right to withhold delivery of any goods purchased by the customer until such costs have been paid.
6. Solar Plexus does not operate any 'sale or return' policy for distributors or installers. This can only be arranged by prior agreement in writing. (This is not applicable to retail customers).
SHIPPING
All goods are sold ex-works. This means that we do not accept responsibility for the security of the goods during transit. Customers should arrange their own transportation of the goods from our premises. Alternatively, we can arrange transportation at the customer's request, however there are some important points:
a. Standard insurance only is provided, unless the customer has requested otherwise in writing. Standard insurance is £2.50/kg. Any claim against Solar Plexus for loss or damage in transit is limited to this level unless additional cover has been requested in writing, agreed and paid for.
b. It is the customer's responsibility to ensure that goods are thoroughly checked for damage before signing 'received in good condition'. Failure to do so will invalidate any shipping insurance claim. Solar Plexus will not be held responsible for any insurance claim for damage where a signature has been received by the courier on delivery indicating that the goods were received in good condition
c. Solar Plexus requires that in the event of shipping damage, the customer must retain all packaging and equipment for inspection by the company and/or the courier. Failure to do so will invalidate the shipping insurance. Damaged goods must be returned to Solar Plexus at the customer's expense if they are to be replaced. No replacement or refund will be granted prior to the outcome of the courier's investigation, and will be dependant on a successful outcome.
SPECIAL TERMS FOR EXPORT:
For the purpose of these terms and conditions, 'export' means purchases made by companies outside England, Wales and Scotland. These specific 'export' terms and conditions will also apply to sales made to companies in the UK, if the goods are shipped outside of England, Wales or Scotland, be it carried out by the customer or by Solar Plexus on behalf of the customer.
In addition to the standard terms and conditions above, the following conditions will apply:
1. Damage to the goods in transit is more likely with long-distance shipments. Therefore it is advised that the customer should make appropriate arrangements for insurance of the cargo. If the customer wishes Solar Plexus to arrange the insurance, this must be provided in writing to Solar Plexus at the time of sale, specifying the value of cover required. The value of the cover may not exceed the value of the goods.
2. If insurance has been taken out on behalf of the customer by Solar Plexus, no payment shall be made to the customer in respect of damage or loss of the goods until the shipping company has paid compensation Solar Plexus in respect of damage or loss of the goods. The amount payable by Solar Plexus to the customer shall not exceed the amount paid to Solar Plexus by the insurance company.
3. In the event that goods are damaged in shipping, or in the event that the goods fail due to faulty goods or workmanship, in accordance with the standard terms and conditions and the specific export terms and conditions outlined above, the cost of shipping faulty or damaged parts back to Solar Plexus, including any duty, customs clearance costs, agents fees or other export-related cost and the cost of shipping the replacement part out to the customer including any duty, customs clearance costs, agents fees or other export-related cost is the responsibility of the customer. Alternatively, the customer may visit our premises by arrangement to exchange the faulty unit. No exchange or refund will be given without the return of the original part.

DEFINITIONS:
'in writing' : postal letter, fax or hand-written notice. This does not include emails or verbal conversations 'misuse': any form of use which is not specified by Solar Plexus or the product manufacturer.
